Why the instrument is not for sale

A rationale, a polemic, and a return cut

The restriction protects a question from becoming a credential.

The Zizkian asks who receives authority from an interpretation, who carries its cost and what observation could defeat it. Its noncommercial release puts the same questions to the person offering the instrument. The code can be inspected; the prompts can be criticized; a reading can be withdrawn. The package is not offered as a proprietary explanation that only an accredited interpreter may deliver. Nor is this claim a proof that the license produces that outcome.

This is the project’s ethical position. The actual legal permissions are the unmodified licenses described in licensing scope.

The case for strictness

A consulting framework can supply two things at once: a useful set of questions and an authority to declare what someone else’s problem really is. The second is tempting because it can be sold before the first has earned its place. A matrix gives the interpretation a technical appearance. A memorable name gives it an identity. A certificate gives someone permission to speak in that identity. None of these establishes that the client needed the interpretation.

Our own construction already approached this trap. Its weights were authored attention choices. They acquired a suggestive mathematical costume without an operational role. The correction was not to advertise our humility. It was to remove the weights from decision authority and let a supported ordinary answer close the inquiry.

The license extends that correction to distribution. Noncommercial inspection, adaptation and study can proceed under the stated terms. Commercial exploitation of these licensed files is not a permission this public release offers. Someone cannot obtain a commercial permission merely by appending a profound explanation of why their service is exceptional.

The target is capture: turning a public instrument of criticism into an enclosed credential for criticism, then billing the people whose assumptions it examines. This is a project judgment about what should happen to this artifact. It is not an empirical claim that every paid practitioner does harm.

The objection: people need to earn a living

The strongest objection is not a slogan about markets. It is a person doing necessary work, with rent, responsibilities and limited time. Good facilitation can require preparation, attention and skill. Payment can support those things. An unpaid arrangement can exploit the facilitator just as surely as a paid one can exploit a client. A license that treats every exchange of money as moral contamination would miss this ordinary explanation.

We accept the objection. The Zizkian is not a theory proving that work must be free. Its restriction concerns permission to exploit this particular authored package commercially. The standard licenses have their own definitions and exceptions; the polemic does not replace them with a vague test of personal purity. Readers can reject the project’s choice without that refusal becoming evidence that they secretly enjoy domination.

The refusal is nevertheless consequential. This release does not offer a paid commercial license, a certification business or an accredited-practitioner tier. Its position is not: everyone must abstain until they pay the author instead.

The objection: you are protecting a brand

Perhaps strictness is another route to authority. The author keeps control, receives attention for refusing profit, and converts the refusal into prestige. The apparently generous act can produce a new monopoly: only the originator gets to be the person who gave the gift.

This objection belongs inside the method. The return cut names that possible payoff. The author can benefit from recognition and from being perceived as unusually principled. A declaration of awareness does not cancel that benefit. The practical response is to keep the method inspectable, preserve the right to criticize it, publish failure criteria and apply the noncommercial position to the author as a project policy too.

This policy cannot magically abolish the legal powers of a rights holder. A later commercial carve-out would contradict the present position and should be named as a reversal, not concealed in an updated license file. No clause here claims to forbid future people from thinking similar thoughts.

The objection: restrictions can entrench the powerful

A small practitioner may depend on reusable materials more than a large firm does. A large firm can develop its own wording and implementation. A public noncommercial restriction might therefore burden the person we hoped to help while leaving the organization we distrusted comparatively untouched.

That is a real possible failure of the design [1 SPECULATIVE | no adoption comparison]. The license should not be defended by treating every such case as an acceptable sacrifice to an immaculate principle. Document denied uses and beneficial adaptations. The early warning is straightforward: people doing useful, accountable work cannot use the package, while commercial actors imitate its ideas without needing its files. If that pattern appears, reconsider the licensing choice openly.

There is a legal boundary as well. The copyright license concerns protected expression and covered use of these files, not ownership of an abstract question or every method of critique. The distinction is stated in licensing scope. The words “What would prove that reading wrong?” are not claimed as a new invention or a privately owned line of thought.

The objection: this is a purity ritual

A restriction might make the author feel clean while changing little. The same institutional incentives persist. A consultancy can publicly praise the method, borrow the vocabulary and continue its old practice. Meanwhile the community argues about whether a workshop was sufficiently noncommercial. The refusal becomes theatre, and the theatre displaces the decision.

The answer cannot be a more dramatic refusal. It must be an observable change. Can people examine the source? Can an interpretation be rejected? Can a test remove it? Can someone close the inquiry without purchasing the next level of depth? Are the author’s claims subject to those same conditions?

The package supplies records and a checker for part of that task. A passing record does not answer the entire social question. A false source can still pass a structural check. A noncommercial setting can still abuse authority. The license is a boundary on granted use, not a moral certificate.

The project’s answer

The Zizkian will not grant commercial exploitation through this public release. The refusal is deliberate and revisable as a project judgment, while permissions already granted remain governed by their standard license terms. The code and documentation are available for criticism and for the noncommercial purposes those terms permit. The author offers no special commercial exemption here.

We choose this because the instrument’s premise should also bind its packaging: authority must remain inspectable, a reading must be able to lose, and the person receiving an interpretation must retain a way out. If the license itself becomes an instrument for silencing that person, the Zizkian has work to do on its own release.

It has not earned an exemption from its question.
